Terms of service

These terms are the agreement between you and WETYR Corporation, doing business as SnagMyCar ("SnagMyCar," "we," "us"), 8420 Maria Court, Cape Canaveral, FL 32920. They apply when you use snagmycar.com or sign up for our service. By paying the deposit, you agree to them. If you do not agree, do not sign up.

1. What we do

SnagMyCar is a buying agent that works for you, the buyer. When you sign up, you tell us the new car you want, including make, model, trim, acceptable colors, must-have features, how far you will travel, and whether you want pickup or delivery. We then:

1. Look for matching new cars in stock at franchised dealers within your radius.
2. Email those dealers and ask for a written, itemized out the door price.
3. Share the best written number with the other dealers and ask them to beat it, then give the top two a final chance.
4. Send you a side by side list of the written quotes with an estimated pickup or delivery cost for each.
5. After you choose a quote, tell that dealer, receive its buyer's order, and check that it matches the price you chose.

We usually have quotes ready about three to four days after you sign up. That is an estimate, not a promise. Timing depends on dealers, inventory and how quickly you respond.

2. Who pays us

You do, and only you. We do not accept money, commissions, referral fees or anything else of value from dealers, manufacturers, lenders or any other company involved in your purchase.

3. Fees

Our total fee is $499, charged in two parts:

• $99 deposit, charged when you sign up.
• $400 success fee, charged only after the dealer you chose sends a buyer's order that matches the price you picked from our list. If no matching buyer's order is ever produced, we do not charge the $400.

Our fee is for finding cars and negotiating price only. It is separate from the price of the car, taxes, government fees and dealer fees, which you pay to the dealer.

4. Our guarantee and when the $99 is refunded

When you sign up, you may give us the best written out the door quote you already have from a dealer for the same car (same make, model, trim and substantially the same equipment). If the best quote we deliver does not beat that quote's out the door total, we refund the $99 deposit and you owe us nothing.

We also refund the $99 if we cannot get at least one written out the door quote for a car that matches your request within your radius. If you cancel before we have contacted any dealers, we refund the $99. Once we have contacted dealers, the deposit is non-refundable except under this guarantee. Refunds go back to the original payment method.

To use the guarantee, the quote you give us must be a real, written, itemized out the door price from a dealer, dated within the last 14 days, for a car that was in stock. We compare totals on the same basis: selling price, dealer fees, add-ons, taxes and government fees, excluding any trade-in and any financing terms.

5. Your permission to contact dealers and share your information

By signing up, you authorize us to contact dealers on your behalf about the car you described, and to share the details of your request with them. We do not give dealers your name, email address or phone number while quotes are being collected. After you choose a quote, you authorize us to share your name, email address and phone number with the dealer you chose so it can prepare your buyer's order and complete the sale. We share your contact details only with that dealer.

You agree to give us accurate information and to tell us promptly if your requirements change.

6. You buy directly from the dealer

We are not a dealer and we are not a party to your purchase. The dealer sells the car to you under its own contract. You decide whether to buy. We do not take title to any vehicle, hold any vehicle, or receive or handle any money for the purchase of a vehicle. You pay the dealer directly, and the dealer titles and registers the car in your name.

You are responsible for:

• Inspecting the car before you accept it, whether you pick it up or it is delivered.
• Reading the dealer's contract and other documents before you sign, and confirming they match the buyer's order we checked.
• Deciding whether to buy any optional products the dealer offers.
• Arranging insurance, and meeting your state's registration and inspection rules.

We check that the buyer's order matches the price you chose. We do not inspect vehicles, and we are not responsible for a vehicle's condition, the dealer's performance, manufacturer warranties, recalls, delivery delays, or anything a dealer adds to or changes in its paperwork after our check.

7. Financing and trade-ins

We do not arrange, offer, sell or broker loans or leases, and we do not submit credit applications for you. We may suggest that you get a pre-approval from a credit union or bank of your choice before buying. That suggestion is free and general; we receive nothing from any lender. Any trade-in is a separate deal between you and the dealer.

8. What we do not promise

We do not promise a specific price, a specific discount, or that any particular car will be available. Dealers set their own prices and may change or withdraw a quote, or sell the car to someone else, before you buy. Written quotes are the dealer's statements, not ours. Some brands sell direct to consumers without franchised dealers, and our service does not apply to them. We currently handle new cars only.

9. Where we offer the service

We currently serve buyers who live in Florida, Ohio, Tennessee, Massachusetts, Delaware, Vermont, Wyoming and Idaho. Many states regulate or prohibit car buying agents, so we do not offer the service to residents of other states. If you sign up from a state we do not serve, we will refund your deposit.

10. Limitation of liability

To the fullest extent the law allows, our total liability to you for any claim related to our service is limited to the amount you paid us for that search, and we are not liable for indirect, incidental, special or consequential damages, including lost time, travel costs, or the difference between prices you paid and prices you might have paid elsewhere. Our service is provided as described in these terms; we make no other warranties. Some states do not allow certain limits, so parts of this section may not apply to you.

11. Ending the service

You can stop a search at any time by emailing us. Refunds follow section 4. We may decline or end a search if a request falls outside the service, if we cannot serve your state, or if information you gave us is false. If we end a search for reasons other than false information from you, we refund the $99.

12. Governing law and disputes

These terms are governed by the laws of the State of Florida, without regard to its conflict of law rules. If you have a problem, email us first and we will try to resolve it. Any dispute that cannot be resolved informally will be heard in the state or federal courts located in Brevard County, Florida, unless the law of your state gives you the right to bring it where you live.

13. Changes to these terms

We may update these terms. The date at the top shows the latest version. Changes do not apply to a search that is already under way unless you agree to them.
